1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the website at partmart.com and all associated pages, features, and services (collectively, the "Platform"), operated by Partmart.com Pty Ltd (ABN 97 090 796 848) ("Partmart", "we", "us", or "our").
By accessing or using our Platform, or by placing an order with us, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.
These Terms should be read together with our Privacy Policy, which is incorporated by reference.
2. About Partmart
Partmart is an online retailer specialising in Honda motorcycle and powersports parts, accessories, and related products. We have been serving the Honda parts community since 1996 and operate from Australia with customers worldwide.
Partmart is not affiliated with, endorsed by, or an authorised agent of Honda Motor Co., Ltd or any of its subsidiaries, except where expressly stated. Honda and related trademarks are the property of their respective owners and are used solely for the purpose of identifying compatible products.
3. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to place an order or create an account with us. By using our Platform, you represent that you meet this requirement.
If you are purchasing on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
4. Products & Compatibility
We make every reasonable effort to ensure product descriptions, specifications, images, and part numbers listed on our Platform are accurate. However, due to the nature of the motorcycle parts industry, variations may exist between model years, regional specifications, and vehicle configurations.
Your responsibility
It is your responsibility to verify that any part or product you purchase is compatible with your specific vehicle before ordering. We strongly recommend you:
Cross-reference the part number against your vehicle's service manual or OEM parts catalogue
Check the model year, region of manufacture, and variant of your vehicle
Contact us if you are unsure — we are happy to assist
Product availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or decline orders at our sole discretion. If a product you have ordered becomes unavailable after payment, we will notify you promptly and offer a full refund or suitable alternative.
Pricing
All prices displayed on our Platform are in Australian Dollars (AUD) unless otherwise stated. Prices are inclusive of GST where applicable for Australian customers. We reserve the right to correct pricing errors at any time. If a pricing error affects your order, we will contact you before processing.
5. Orders & Payment
Order process
Placing an item in your cart does not constitute an order. An order is formed when you complete the checkout process and we send you an order confirmation. We reserve the right to cancel or refuse any order for any reason, including suspected fraud, error, or unavailability.
Payment
We accept payments via the methods displayed at checkout. All payment transactions are processed by a third-party payment processor using industry-standard encryption. We do not store your full payment card details on our systems.
Payment is required in full at the time of ordering unless otherwise agreed in writing. Orders will not be dispatched until payment is confirmed.
Fraud prevention
We reserve the right to perform identity and fraud checks on orders. We may request additional information to verify your identity. If an order is suspected to be fraudulent, we will cancel it and may report it to the relevant authorities.

We aim to dispatch orders within the timeframes stated on our Platform or at checkout. Dispatch times are estimates only and do not constitute a guarantee. Delays may occur due to stock availability, carrier delays, or circumstances beyond our control.
Risk of loss
Risk of loss and title for products pass to you upon delivery to the shipping address you provide. We are not responsible for loss, theft, or damage after delivery.
Incorrect address
You are responsible for providing an accurate and complete delivery address. We cannot be held liable for orders delivered to an incorrect address provided by you. Any costs incurred to redirect or re-deliver due to an incorrect address will be at your expense.
7. International Orders
We ship to a range of countries worldwide. By placing an international order, you acknowledge and agree to the following:
Customs, duties & taxes
Your order may be subject to import duties, taxes, customs fees, and other levies imposed by the destination country. These charges are entirely your responsibility and are not included in our prices or shipping costs. We have no control over these charges and cannot predict their amount.
You are responsible for complying with all laws and regulations of your country regarding the importation of goods. If you are unsure, please check with your local customs authority before placing an order.
Refused or returned shipments
If a shipment is refused at customs or returned to us due to your failure to pay applicable duties or comply with import requirements, any costs of return shipping and associated fees will be deducted from any refund due to you.
Restricted parts
Certain parts may be restricted or prohibited for import in some countries. It is your responsibility to ensure that the products you are ordering are legal to import and use in your jurisdiction. We will not be liable for orders seized or restricted by customs authorities.
Consumer law
If you are located outside Australia, your statutory consumer rights may differ. The Australian Consumer Law may not apply to your purchase. We encourage international customers to review their local consumer protection laws.
8. Returns, Refunds & Warranties
Australian Consumer Law
For Australian customers, our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Change of mind
We are not required by law to accept returns for change of mind. However, we may, at our discretion, accept returns of unused, unopened products in their original condition within 30 days of delivery. Any approved change-of-mind return may be subject to a restocking fee and return shipping at your cost.
Incorrect or faulty parts
If you receive a part that is incorrect (not as described or ordered), defective, or damaged in transit, please contact us within 14 days of receipt. We will assess the issue and, where appropriate, provide a replacement, exchange, or refund.
Compatibility issues
We are unable to accept returns for parts where the incompatibility arises from incorrect information provided by the customer (e.g., wrong model year or variant) or where the customer failed to verify compatibility before purchasing.
Return process
All returns require prior authorisation from us. Please contact us at support@partmart.com before sending any items back. Unauthorised returns may be refused.
9. Intellectual Property
All content on our Platform, including text, product descriptions, photographs, graphics, logos, and software, is owned by or licensed to Partmart and is protected by Australian and international copyright and other intellectual property laws.
You may access and use our Platform for personal, non-commercial purposes only. You must not:
Reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent
Use our branding, logos, or trademarks without authorisation
Scrape, crawl, or systematically extract data from our Platform
Frame or mirror our Platform on another website
Third-party trademarks, including Honda and related marks, are used on our Platform solely for descriptive and compatibility purposes and remain the property of their respective owners.

When using our Platform, you agree not to:
Engage in any unlawful, fraudulent, or deceptive conduct
Upload or transmit any malware, viruses, or harmful code
Attempt to gain unauthorised access to our systems or other users' accounts

We reserve the right to suspend or terminate your access to our Platform if you breach this section or any other provision of these Terms.
11. Limitation of Liability
To the maximum extent permitted by law (including the Australian Consumer Law), Partmart's liability for any claim arising out of or in connection with your use of our Platform or any product purchased from us is limited, at our option, to:
Replacement or re-supply of the product; or
Refund of the amount paid for the product.
We are not liable for any indirect, incidental, special, consequential, or punitive loss or damage, including loss of profits, loss of data, property damage, or personal injury arising from:
Your use or inability to use our Platform
Any products purchased, including damage caused by incorrect fitment or use
Delays in delivery
Unauthorised access to or alteration of your data
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified.
12. Indemnity
You agree to indemnify, defend, and hold harmless Partmart.com Pty Ltd and its officers, directors, employees, agents, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
Your breach of these Terms
Your use of the Platform in violation of any applicable law or third-party rights
Incorrect or misleading information provided by you in connection with an order
Any claim by a third party relating to your use or misuse of a product purchased from us

These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia for the resolution of any dispute arising from or connected with these Terms.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed from these Terms without affecting the validity and enforceability of the remaining provisions.
These Terms constitute the entire agreement between you and Partmart in relation to your use of our Platform and supersede all prior discussions, representations, and agreements.
